A BILL expiring funds to the unappropriated surplus balance in the state fund, general revenue, for the fiscal year ending the thirtieth day of June, two thousand two, in the amount of thirty million one hundred sixty-two thousand dollars from the revenue shortfall reserve fund, fund 2038, organization 0201, and making a supplementary appropriation of public moneys out of the treasury from the unappropriated surplus balance for the fiscal year ending the thirtieth day of June, two thousand two, to the governor's office, civil contingent fund, fund 0105, fiscal year 2002, organization 0100.

WHEREAS, The Legislature finds that it anticipates that the funds available to assist flood victims and to fund other needed infrastructure and other community development projects throughout the state will fall short of that needed during the fiscal year ending the thirtieth day of June, two thousand two; and

WHEREAS, The governor submitted to the Legislature a statement of the state fund, general revenue dated August 8, 2001, setting forth therein the cash balance and investments as of July 1, 2001, and further included the estimate of revenues for fiscal year 2002, less net appropriation balances forwarded and regular appropriations for fiscal year 2002; and

WHEREAS, The revenue shortfall reserve fund has a sufficient balance available for appropriation in the fiscal year ending the thirtieth day of June, two thousand two; and

WHEREAS, By the provision of the statement of the state fund, general revenue and this legislation there now remains an unappropriated surplus balance in the state treasury which is available for appropriation during the fiscal year ending the thirtieth day of June, two thousand two; therefore
Be it enacted by the Legislature of West Virginia:

That the balance of funds in the revenue shortfall reserve fund, fund 2038, organization 0201, be decreased by expiring the amount of thirty million one hundred sixty-two thousand dollars to the unappropriated surplus balance of the state fund, general revenue, and that the total appropriation for fiscal year ending the thirtieth day of June, two thousand two, to fund 0105, fiscal year 2002, organization 0100, be supplemented and amended by increasing the total appropriation by forty-two million two hundred twenty-two thousand eight hundred fifty dollars as follows:

The purpose of this bill is to expire the sum of thirty million one hundred sixty-two thousand dollars from the revenue shortfall reserve fund, fund 2038, organization 0201, and to supplement the governor's office, civil contingent fund, fund 0105, fiscal year 2002, organization 0100, in the budget act for the fiscal year ending the thirtieth day of June, two thousand two, by adding forty-two million two hundred twenty-two thousand eight hundred fifty dollars to the appropriation for civil contingent fund - total - surplus for expenditure during the fiscal year two thousand two.
